Maternity leave is a mandatory one when female employees are working for any organization. Organization cannot say no for that.

Hi,
Is there any ground or execuse available for the employer to avoid to pay 84 days salary; especially in the present scenario of recession.
The organisation; working on time basis, really the situation is problematic.
Is there any protection under any law available to employer or provision of reimbursement from the govt to the employer in these cases where the employer is not the party of the incident.
Pls comment.

Dear Friends,
There are two aspects in this,
1. The number of days a woman has to work to become eligible for maternity leave. A woman employee should have worked 160 days preceeding her date of delivery to become eligible for maternity benefit.
2. The number of days a woman can avail once she becomes eligible. Eligible women under this benefit get 84 days of maternity leave.

Eligibility is minimum 80 working days either continuous or continual for a period of 12 months. The leave with pay should be provided for 12 weeks, the flexibility of availing this 12 weeks is on the employee onus and one more thing stated in the law is another 4 weeks with pay should also be paid if the employee provides a doctor certification saying she has developed illness because of the maternity and needs one more month bed rest. As per legal compliance.

I am working for MNC IT Firm,would like to know whether Female Emplyees proceedeeing on maternity leave can combine their sick leave & casual leave along with maternity leave.Also would like to know whether the leaves accured(vacation leave sick leave,casual leave)during maternity levae of 12 weeks be combined with maternity,or they have resuem duty to avail this leave.
Plz advise.
As per policy it's 18 Vacation leave,6sick levae & 6 casual leave.

Latha, U can calculate the number of leave available on prorate basis and can be combined with the maternity leave.

Maternity Leave can be clubbed with CL or any other leave available.
For eligibility of maternity leave woman should have worked at least for 80 days, not 160 days.
Maternity Leave of 12 weeks will include all sundays and holidays which intervene.
A maximum six weeks of Maternity leave shall be taken before the date of delivery whereas it is not compulsory that 6 weeks leave should precede the date of delivery.

I am confused total 6 weeks or 12 weeks to take and minimum eligibility is 80 days or 160 days for leave.Any statutory formalities are also required to fullfil befor applying for maternity leave
