Myself Aruna working in an E-commerce sector in Hyderabad for the last 7 years. My company doesn\'t have any Gratuity benefits for its employees. Now our company wants to implement Gratuity.
Now, I want to know if I am eligible for a gratuity for the last 7 years of my service or if my gratuity will start fresh when it is implemented by the company.
Please guide.

    Thanks for the clarification. Can any one tell me if Gratuity,which is 4.81% on Basic salary, is deducted from the gross pay of the employee or it is contributed by the employer alone? Thank you.

    The establishment doesn't introduce the Gratuity, rather it applies once employing 10 or more employees.
    You need to refer the defination of the Payment of Gratuity Act, 1972, mandates employers to pay gratuity to employees, and it applies to establishments employing 10 or more workers, including factories, mines, oil fields, ports, and railways, among other.
    All the employees including you are eligible for the gratuity from the beginning, provided your establishment had engaged employees strength of 10 or more.
