Dear All,
We have a Garment Export Unit in Roorkee where more than 500 empoyees are working. As per Factory Rule 1950 we have to engage Doctor/Nurse. No doctor/nurse ready to work in Factory. We have tie up with near by hospital and done agreement and they will provide all facility of doctor/nurse. Doctor will visit the Factory thrice in a week and nurse will available during working hours in daily basis. If nurse is not available B. Farma can engaged for that. It will fulfil our requrement or not under factory rules.

Dear prabha, I am not familier with Factory rule 1950. I don’t wanna give a wrong direction without knowing something as per act. Some of senior members will guide you on this matter.

You may consult the Directorate of Industries Safet and Health office and explain your difficulty.
They shall suggest an amicable solution.
It shall be legal as well.
Many industries in different parts of country have this problem.
Your solution aparently looks logical but has to be approved by them.

Please ensure that you get an approval in writing for your arrangement.
Till then semd a letter to the factory inspectors stating your problem. You should outline the efforts made, cv you have got, etc to substantiate the statement that doctors do not want to work in the factory
Get an Acknowlwdgement of your letter.
It will be some thing in your favour till you get the approval

Dear Prabhat,
If we talk about Law, you have to engage Medical officer and Nurse/Compounder within your factory premises as per the safety prohibition under Factory Act 1948.But still you can take exemption,need to give justification to your factory Inspector.Just set your ground stating that the facilities that you are going to provide is not less favorable as mentioned in Rule 65,66,66A,section-45 and try to take exception base on Section-50 and get approval in written.

Dear Madam,
Refer to your query on the above subject,if your industry comes under occupational Hazards under Sehedule 1 of Facories Act -1948 Rules and also state rules applicable to the said act,you can appiont Doctor/Nurse with amemities of Rooom with facilities and also ambulance etc., compulsory.otherwise you can tie up with the hospital nearer to your industry with the amenities stated above is sufficient on your part.
