All Respected Seniors,
I want to know one thing, if we enroll an employee "Exempted" in payroll and because of incorrect parameters, the payroll deduct his epf contribution. Even the bank challan are also submitted to the bank. So now, can we stop the epf deduction of that particular employee for future..?? If yes, then how and what will be the contribution which was wrongly deducted..??

At what stage you are in?
Are you already submitted the Form 5,Form 10 and Form 12A along with challan?
Are you included that employee's name in the Form 5?

If you already submitted the form 5 @ monthly return then in next month in form no.10 you mentioned those exempted emploee's name then you stop deduction agaist salary.

I mean this is some serious mistake you have ommitted while preparing EPF challan, once an EPF member declared exempted from EPF limit cannot be mentioned as EPF members.
I am totally agree with Mr. S. Sethupathy, once the member taken as EPF member you have to continue his EPF deduction till his official resignation and submit form 5-10 and nomination form so dat his deduction and personal details may convey to the regional office records.

Thanx to all of you.
Actually, I haven't made this mistake. The payroll s/w we r using, ask(yes/no) to make exmpt the emp. if its basic is above Rs 6500/- at the time of enrollment. But, I was in hurry n by mistake clicked on no. So, the s/w ded. his pf. I cought this mistake at earlier. But, later I thought, If the mistake was not coughten then what are the ways I should adopt further. Thats y, I put this discussion here.

But, here I got 2 diff. views.
Ajay Sir is saying that, v cn show that person "Exmpt" in Frm-10 nxt mnth n cn stop deducting epf.
Where as Chinmay Sir is agree with Sethupathy Sir, n says that, V hv to take an official resignation from such emp. Then v cn show "Exmpt" that emp. in Frm-10 in nxt mnthly retrn.
So, Its is somethng complex. So seniors, Plz. clear this.

Dear Bcarya,
You can show his name in Form 10 and while sending the next monthly returns, attach a separate letter to PF Commissioner, narrating the whole story and why he was wrongly included when he is actually an exempted employee. You can mentioned as " Exempted-wrongly included " in Form 10.
Don't forget to obtain Form 11 from that employee, if possible send a copy of the same to the EPFO along with the employee's request letter.
