Hi,
I have a joined a company last week , i surrendered all my originals from X to Degree Certificates. I also signed a bond for Rs.2,00000/ bUt they didn't gave me the bond copy and also offer letter. Now i am get torched daily for last two days. i want to resign that job, how i can get back my orginals please help me

It is regretting to note that you have deposited all your certificates with the employer in original. You should not have done a mistake like that. I don't think that the company would give the certificates back once you resign without any intervention by some powerful official. Also, I will not advise you to continue with such employer who will always have a tendency to exploit you. Therefore, submit your resignation and take assistance from the Labour Officer to collect back the certificate. Since the bond you have signed has no legal validity the employer can not insist you to pay the amount. If you smell that the Labour department also plays along with the employer (as it is also seen that employers may have good rap with Labour departments) you will have to approach higher authorities.

Dear Mr. Kumar,
If you have not received a copy of the agreement duly signed as token of having received the copy, legally the agreement will not hold good as there is no acceptance from your side. However, have you got a receipt from the employer while submitting all your original certificates? If your answer is 'yes', then possibility is there to get back the same.
Pl speak to the HR people, convey your intention (in writing) to leave due to unfriendly Policies / environment and ask him/them to return your original certificates. Get a receipt on the copy or send an e-mail.

Dear Sivakumar
Please follow the steps mentioned above by Respected Madhu.T.K. if those steps fails then lodge an FIR (General Diary) with your local Police Station about the theft of your Original Certificate by your company from your desk intentionally to harass you (give the name of that person who is harassing u). Simultenously u need to do something for Police ( u know what i wanna say) for better results.

You have a right to ask for a copy of the bond. Send your written request to the management to supply you a copy of the same for your reference and record. If they refuse that would indicate their bad intentions. You should also send a written request for return of your original educational certificates and degree, as they would not be legally right to withhold those if your appointment letter and agreement does not contain any provision of surrender of educational certificates and degree to the employer at the time of employment. MIND IT, no one has the right to treat you as a bonded labor.

Hello Dear,I personally feel that you need not get into the act of approaching any of the external officials and instead try to sort out the issue with the employer. It’s a present trend of taking the certificates as a security of you continuing the job till the agreed period. However, if you think that you are unable to cope up with the task given to you then. I feel it’s better to communicate on the lacking areas and your understanding on the given task. Try to sort out the issue within the company. I still believe the company HR will be matured enough to understand the issue if it is genuine and do the justice by giving back your certificates and relieving you from the contract. Regards,Avinash

Dear All,

Looking at the matter and with due respect to the suggestions given by the various members, I just want to say that why people generally assume that the HRD would not cooperate with the candidate, I being an HR professional personally feel that our basic motto is to establish a win-win situation for both the employee and the employer, why are we assuming that if the candidate wish to resign he would not get the original documents back, why wont the HR people understand the employees point of view (in case the reason sounds logical) and the the last question is for Siva Kumar, though I do not know what you mean by you getting tortured coz one week's time is not sufficient enough to judge the company and the people out there, I think you must try and cope up with the situation, try and have a open word with your seniors and sort out the matter, if possible else you should resign and try to get the original documents, which acc. to me would be handed over to you without much difficulty.

I hope the members would take the above in a positive manner and would guide me if you find anything wrong with what has been said.

Usually The HR people don't directly contact to the concerned person. They 1st contact to their senior to pass the information.And it is the senior who usually misinterpret the request and start harassing the candidate, or asking the question which is irrelevant.

I am giving my example

1st;-
I was working to the Leading Liquor company and i was looking my job profile etter from HR. working in the MNC i thought i should send the request to HR Dept directly,so i did. Then The HR department replied to the My senior in SALES dept that i am looking for the letter, and senior starts asking that why do you looking for JOB PROFILE LETTER, do you want to know your job or want to work as per sales profile which he was giving to me.

2nd;-
Sales people usually donot get the Holiday list from HR. It is the senior in sales department who decide your holidays. At 11th hour he will sanction the leave, and if a person who is working out of station ( 1000 kms from Native place ) will be at no where.
