Dear All,
Sunday is weekly holiday in my company. My question is that if any employee takes leave on Saturday & Monday Should company pay him for Sunday?
Another one is if A employee takes leave for a month and there is 3 paid holidays (Festivals) in the respective month. Would the employee be eligible for those 3 days payment. However, there is no any CL & PL in my company.
Kindly reply.

Dear Urgy,
By only telling that you are running a proprietorship company I am not in a position to tell you that under which of the labour law you are required to grant weekly off with or without wages. We will be in a position to know the Rule when we could examine or finalize that which Act is applicable to the Company.

Intervining Festival Holiday or Weekly-Off NORMALLY shall be taken into count while granting leave for an employee. If the employee goes on unauthorized absence, then the intervining HOLIDAYS will be also treated as unauthorized absence.

It is most immaterial and irrelavant how the firm/Company has been formed..a Proprietershi, Pvt. Ltd or a Limited Co....insofar as Leave rules are concerned.
What matters is under which law are you registered...Factories Act or the Shops Act.
Once you unravel this "secret", then you can read the relevant portions/sections of the applicable law and get a cear picture of the leave rules that would apply to your company/firm.
However, I am shocked when you state that your company does not have system of SL/CL & PL. This is against law.

Dear Sir,
Thanking for your reply.
My company is registered under Shop Act. So, could you share the rule regarding paid holiday as we are discussing here in respect to Shop Act.
It is really shocking that my company does not have CL, PL. My company is registered under Shop Act, provides Security Services & having license i.e. PSARA (Private Security Agency Regulation Act-2005), Guard Board Exemption and other certificates e.g. PF, ESIC, PT. ST. Company have approximately 250 employees but there is no any kind of leave aforesaid.
