Hi,
I working with an IT company, I need to calculate the maternity benefit of an employee who work with us from last 7-8 yrs. Her current salary is approx 50,000.
1. With reference to the information which i get maternity benefit should be calculate as below mentioned :
Average salary per month = ( net salary of last three month before going on leave ) / 3
Average salary per month / 30 X 72 days. = maternity benefit amount for 12 weeks.
As per ESIC the calculation is Average salary per month / 30 X 84 days = maternity benefit amount for 12 weeks.
2. As she getting highest salary so our consultant is saying that - As per Section 5 first provison Payment of Maternity benefit should be as per [B]Minimum Wages Act as applicable to Shop & Establishment Act
Basic + DA+ HRA = ---- /30 X 72 = Maternity Pay
I need to confirm that which calculation is right & also maternity benefit need to calculate for 72 days / 84 days
Kindly need urgent assistance regarding this.

Hi friends,
Myself Silambarasan very recently i joined in company which is into engineering and construction industry, this is the first time the company facing about maternity, one of my staffs working for last 2years and 4 months as front office cum admin asst, her take home salary is Rs.7500 pm month
she has applied leave from 1st April to June 31st , help me on this about her eligible leaves and salary disbursements.

Dear all, during maternnity benefit which salary we have to pay basic or gross salary and we can deduct PF from her salary or not plese confirm me Regards, Mandeep Gahlawat

It is the gross salary which is to be paid during maternity leave days. Any reimbursement or allowance, if any, which is not paid during leave days shall not be available during maternity leave days also. From this salary you can deduct PF contributions.
