Can a women of age above 40 years avail benefits of maternity leave for removal of uterus in Maharashtra? If yes, then is it specified in the Maternity Benefit Act and for how many weeks.

MATERNITY BENEFIT ACT, 1961 is to regulate the employment of women in certain establishment for certain period before and after child-birth and to provide for maternity benefit. This act may not be applicable to your requirement.

No she will not be eligible for availaing benefit under MB Act.

Maternity leave is applicable only where a woman avails leave before and after delivery of a pregnancy. In normal circumstances, removal of uterus is not covered under the MBAct.
However, in the very uncommon situation where removal of uterus is necessitated due to a severe crisis immediately following pregnancy, for example, severe post partum bleeding or rupture of uterus, removal of uterus would come under the purview of MBAct. But removal of uterus without any connection to a pregnancy complication will not be covered under the Act.
