We are an Software Development Company with an Employee strenth of 68.
- For Leave we maintain the calender Year Jan-Dec.
- SL cannot be carried forward, EL can be encashed after it is accumulated to 24 leaves.
- Leaves are credited every month (2 days every month,i.e,1 CL 1 SL)

with my knowledge i would give u a kind of leave policy
as u said ur holiday year is calculated from 1st of Jan to 31st of Dec
by 1st of every month 0.5 days of CL and SL & 1 day of EL should be credited.
EL is normally utilised for travelling purpose, since LTA can be availed for EL alone, if a person is on tour(personal) by availing CL he is not eligible to avail LTA.
so as u start a year only the SL and EL will be > 0.5 days.
Do mention that no two types of leave could be merged(say for eg. 0.5 days of CL and 0.5 days of SL)
if a person avails >2 days of SL, he shld submit the Medi Certificate on his joining. else will be considered as LOP.
uninformed leave for 3 days need not be acceptable and the emp should meet the disciplinary commitee( hr, reporting person, and his reporting person)
In case a person is planning to avail EL he should get prior permission from his reporting person else will be termed as LOP (since most of the travelling is well planned ahead of it)
In case if the emp is directly reporting to people abroad, he should inform his reporting person in india and after his approval can inform the person abroad and this shld have HR in the loop.
Any non-working day/days (National Holidays/Festival Holidays/ Week Ends) falling during the period of earned leave (excluding the prefix and suffix) will be treated as part of your earned leave. For example, if you take special sick leave from Thursday to the following Wednesday, this is regarded as seven days of absence.
so if a person is going to avail EL for 5 days hopefully he is going to loose almost 5+4 days of EL(9 days)
this applies to SL as well since you have deem the carried forward SL as special sick leave and this rule of adding the holidays can be brought in for SPecial SIck leave.

1. I m working in garments firm in Gurgaon where 22 leave are given, out of which 15 are E.L and 7 are C.L. and no sick leave is provided.
So I want legal comment on the same that what is the base of leave i.e C.L, E.L and S.L according to law.
2. Weekly off is paid on the following basis.
It is given only in a case when employee have more than 3 working days in the week just before the concerned weekly off.
And in other firms I have observed that weekly off is deducted if employee is on leave before and after the weekly off.
On the same I want your legal view.

Now, we credit every month 2 leaves .5 CL , .5 SL and 1 EL.So,if anyone have to take two days leave or one day leave for CL or SL then will it be LOP.
Secondly,if we alot 1 EL every month then how it can be applicable for for EL that it has to be taken for more than 2 days at a stretch?
And more of all we are crediting 1 EL everymonth.
