Dear All
I want to understand whether HRA is a part of minimum wages as defined in MW Act.
I understand that HRA has to be 5% of Basic+DA.Pl. let me know Under which notification, this has been notified in Maharashtra.
Wages as per MW Act is inclusive of all allowances. Whether HRA can be included to arrive at Minimum wages.
Thanks

Dear Vasu
As far as I know the Minimum wages state that that that much money is to be paid to him. It does not state that the basc should be the amount mentioned in the Minimum Wages. Moreover there is no restriction of what the basic pay is but overall the amount should be the amount of minimum wages to be paid to him on the category he is working.
Request the other members to correct me if i am wrong and also atleast motivate me if I am correct so that I may continue wth this help.
Thanks

well HRA is the House rent allowance given to the employee. It is the part of the salary but it is not mandatory for the employer to give the hra as component of the salary...yes it is included in the ESI deduction.

Dear ,
As i know HRA is not compulsory but for salary breakup you need to have required % in HRA.
Required percentage is 40% of basic in non metro cities. And 50% percent of basic in metro cities.
thanku.
