HI,

We are a not for profit organisation with 6 employees, employed currently. I would like to know if maternity leave is applicable for organisation with less than 10 employees.

As per the maternity benefit act it mentions that it is applicable to shops & establishments with 10 or more employees. were employed

Request a clarification in this regard

Hi, Obviously coverage not required. However in the process expansion if the number exceeds 10 and above then coverage will apply.

Definitely not because:
Maternity benefit act is eligible for only those who work in an organization with a minimum of 10 Employees.
Maternity benefit act applies to mines, factories, circus, industry, plantation and shops and establishments employing 10 or more persons, except employees covered under the ESIC Act. It can be extended to other establishments by the state governments. There is no wage limit for coverage under the Act.


Thank you for your response, You have mentioned that except employees covered under the ESIC act. We are giving ESIC & PF to the employees, so does this mean that we have to provide maternity benefit.
