We have a Pvt. Ltd. Company. I will be really thankful if I could get the clarity on which ACT to check while deciding on Leave and Maternity Policy for the Company?
We provide software development services. There is a Maternity Benefit Act too. So which ACT is to be referred to as a whole?
How much leniency an IT /Software company have to have their own rules depending on the nature of work and emergencies?

Considering that yours is a software consulting firm, you are covered under the Shop & establishment act for the state you are registered in. You need to check up the aforesaid act for deciding kinds of leaves and hours of employment. Alongside, you need to refer to other labor law acts (Gratuity Act, PF act, Payment of Bonus Act, ID act, ESI etc) which would be useful for the functioning of your organization.
Maternity Act is to be referred only in cases of maternity.

We are a software/web development firm. Could you tell me which state act laws to be followed? The one we actually registered our firm OR the state we are carrying out our actual operations?

Hi,
Maternity Policy, Gratuity Act, PF act, Payment of Bonus Act, ID act, ESI etc is one for the country. Shop and Establishment act has few differences depending on the states. The company should follow the act of the states where it is operating irrespective of the state where it is registered. But if the company has certain rules that will be common to all its branches unless it does not bypass the Indian law.
