If in a IT company only 5 employees are drawing less than 15,000 per month but the total employee count of the company is 100. Whether the ESI act applies to the Company or not? Few says the count is less than 20 not applies and few says the total count i.e. (100) should be considered.
Please help me what’s the current IT/ITES companies practice on this.

Hi For your case ESI is applicable. If the total employment is above 10 & if 1 employee is drawing salary below 15K then Both PF & ESI are applicable.
