Hi,
I have a question about employees on field. Is Overtime applicable to them. e.g. There is field engineer who visits various sites for preventive or breakdown maintainance & gets visit slip signed from the customer which also has time in & out. If such employee has worked more than 8 hours at a site ( excluding travel time) then can he claim overtime.
I had checked up with factory inspector office they say that they are concerned with the activities which are carried out in the factory premises.
Can anybody throw light on this.

Unless otherwise provided in the Standing Orders of the company, travelling sales representatives or other officers are not entitled for overtime allowances. If allowed, there would be no control over the time spent and every late running of Indian Railways or traffic blocks would cost to none but to the company only.

Can anyone put light on the following:-

we have drivers in our company. We will send them for outstation work. we pay da and stay charges. is overtime necessary to be paid for their overnight travelling time?

For working outside the factory or establishment overtime allowances will not be applicable. In R Ananthan Vs Avery India Ltd, Madras and Addl. Labour Court, Madras [1972 (42) FJR 304(Mad.HC)], (1973) ILLJ 166 Mad), it was decided that to attract overtime wages at the rate mentioned, it should be in the factory itself, which means within the factory premises, including the precincts thereof.
