Please explain about labour code Tamilnadu rules and when they will implement them.

Dear Colleague,
As you are aware " Labour is in concurrent List" under The Constitution of India. Hence the Labour Laws are made by both Central as well as State Governments depending on the subject matter and the permitting provisions under each enactments.

As far as Labour Codes proposed by Government of India wherein efforts were made to consolidate 29 Labour Laws into 4 major codes- Code on Wages, OHSWC, IR, Social Security.

These are all under Central Government and the State has to make Rules under certain provisions like Occupational Health, Wages etc for the establishments for whom the Appropriate Government is STATE. Tamil Nadu Government is in the process of making rules and yet to complete the process. Hence once the State is ready with Rules and then as and when the CENTRAL GOVT is announcing date of implementation then it will get implemented in one go. Likey to be in Financial year FY 22-23. Other than this there are STATE GOVT Made Labour Laws are also there and there are no efforts to reform or simplify on those yet.

In case of establishments for whom the CENTRAL GOVT is the appropriate Government, the Central Govt is already ready with Rules. Once Notified the 4 Labour Codes will come into force in next Financial year likely as per information sources.
