Answer to What If a Presiding Officer Verbally Reports Sexual Harassment Complaint against her Superior

In my post on 21.5.20 I presented a Case for advice and guidance of Readers to know if my “Stand” was proper and Lawful. Two Members commented for which I am grateful.

The Case was “What If a Presiding Officer Verbally Reports Sexual Harassment Complaint against her Superior” but expressed her unwillingness to file a Written SH Complaint.

My advice to the concerned Employer was i) to relieve the Presiding officer who reported Sexual harassment with immediate effect to only facilitate, ii) simultaneous afresh Nomination of other eligible Woman-Employee employed at Senior Level, and ii) Notifying the Name of New Presiding Officer of pre-exiting Internal Committee. My advice was in the light of Provision under Section-4 of SHWW (P,P&R) Act 2013. My said advice was accepted in toto and implemented.

The Employer and the IC were successful in persuading the Aggrieved-Woman-Employee Complainant to file her SH Complaint in writing. After completing the Procedure of a) Issuing an Explanation Letter to the Employee-Respondent and b) Seeking and Securing his Written Reply/Explanation in his defence, the Employer forwarded all original Documents to the IC (Internal Committee) for commencing IC Proceedings and requested the IC to submit conclusive and definite Findings on completion of IC Proceedings.

The Case was included in the Compulsory IC Annual Report for Calendar Year 2019.
