I have worked in a Company for 5 1/2 years and submitted my resignation through email to CEO. In our company it is a formality that they do not pay the last month salary. CEO orally informed me that he is not accepting the resignation and not willing to give relieving letter. Is there any way to collect the my last month salary. Till now I have not applied for Gratuity. Can you guide me please.

Thanks for the information. I would like to inform you that there is no specific HR policy in our Company. In the Appointment letter given to me in the year 2012 also they have not mentioned about the notice period. May I know what F&F?

Based on the documents and the evidence, i feel you can establish that you had been in employment for more than five years, and you can file a petition before the Payment of Gratuity Authority for claim of Gratuity.
Your resignation, you reconfirm by sending a copy by registered post to CEO , and prefer an application before the Payment of Wages Authority, for one month salary and relieving letter .

(1) If I proceed to file a petition with Payment of Gratuity Authority and my Company states that it is completely in loss and not able to pay the gratuity. Then what course of action would I have to take.
(2) Sending the reconfirm letter through Registered Post is OK. But in our Office, only two persons are sitting for the last one month i.e., one is CEO and another is mine. One Sales Manager comes but not frequently. Finance Manager resigned. Marketing Manager resigned. Office supervisor resigned. Finally office boy has also resigned. If any posts/courier comes, I would have to open it and place the same on the table of the CEO.
