Need a clarification in regards to latest Maternity Benefit Act 2017, Whether the Act is applicable for private sector too?? If so pls share the details for the same.

I have been denied performance linked variable pay for the period I was on maternity leave. Is this fair. Should I not be paid the amount calculated as per average rating for the period I was on maternity leave?

Dear Amit
Maternity Benefit Act, 1961 is applicable to IT industry. Relevant section is given hereunder.
Sec. 2(b) . Application of Act.-(1) It applies, in the first instance,-
to every shop or establishment within the meaning of any law for the time being in force in relation to shops and establishments in a State, in which ten or more persons are employed, or were employed, on any day of the preceding twelve months.
And as IT industry is covered under S&E Act & therefore this Act applicable on them.
