Is there any Difference between Resignation Acceptance letter and Relieving letter,As while joining a company(BPO) I was asked for Relieving letter (of My First Company) though I have already provided Resignation Acceptance letter in which My last date of working is mentioned and subsequently mentioned that I had been relieved from the company, Take note of that I have already provided them the relieving letter of my last company in which I have worked(Which I believe is more considerable),Kindly suggest over the same.

Generally these are two different letters. Not many issue an accetance letter who would straight away issue Relieving letter, after the notice period satisfactorily completed. In any case a combined letter stating "accepted and relieved" with a date should suffice for the purpose of severence of past service. However mere mentioning 'last date of working' will be short of 'relieving' . Once an employee is stated as "relieved of his/her duties on....date is the requirement (even if it is silent re: resignation accepted or not, as the relieving from the co. is the final word). It is also in vogue when an employee resigns and accepted by the employer a formal letter is issued stating 'your resignation is accepted and you have to servie the notice period from .....to ..... On completion of NP you may be relieved.... like that. In this case since there is no mention to the effect that '''he/she actually relieved".. which is wanting. .

Resignation Acceptance and Relieving are mutually exclusive, I second Mr.Kumar above, an organisation may accept a letter but it does not mean that you have been relieved, any person to serve a notice period during the period for both an individual and organisation have an opportunity to change their mind to continue in the organisation. Therefore, the new organisation where they need is a relieving and not resignation acceptance, because this hound be a legal obligation for the new company. The reliving is total severance form the old company and no more contacts in any manner in that company.

Thanks for reply,But In this scenario the point is that Though it is mentioned as Resignation acceptance letter It was provided to me only after I got relieved from the company ,As I gave my resignation on 8 dec-2014 but got the letter only after relieving(16 jan-2015) Doesn't it serve the purpose of relieving letter? As If it had been entirely a Resignation acceptance letter It would have provided me before my relieving and also not mentioned the date of relieving, In any case Is there any substitute for this?

It's all depends. The importance of a relieving letter gains weightage when the new employer insist for such a thing and when it becomes crucial. Instead, when you don't have, one Experience Letter mentioning the last date of working can do the talking.

Hi,
There is a high probability of disputes arising between the employer and an employee during the notice period, so many companies insist on relieving letters. Some HR guys are highly concerned about asking a relieving letter and a no dues certificate from a new employee as a part of their due diligence process.

Dear Friend, I wish to endorse the views of Sri Ramadurai on ths issue. It is true,after acceptance of resignation and before relieving of resigned employee, a lot of hide and seek game happens and at last moment of relieving , the incharge or HR Manager raises such issues which are detrimental to the interest/smooth reliving of outgoing employee. Hence reliving letter has got significance in present scenerio .Pl.concience your earlier employer to issue a letter of reliving which is a legitimate right of outgoing employee. gpagarwal ,Lucknow



ii) simultenously, I wish to get opioning/guidance from dear members when Resignation has been tendered without insisting for its immediate acceptance and also without specifying NOTICE PERIOD treatment in his resignation.Resignation is accepted after 9 months and the employee is relived suddently one fine day citing it acceptance of resignation.

Later on taking pretext of his resignation without notice all terminal benefits have been curtailed as per provision of RESIGNATION WITHOUT NOTICE. NEITHER PF(EMP.) CONTRIBUTION NOR PENSION IS BEING RELEASED. PL. GUIDE send your feedback on and oblige. gpagarwal ,lucknow.
