Hi,
Kindly guide what to do in case of following situation,
The company calls you for senior position (Product head) and takes all necessary interview with higher authority and completes all formalities after calling you multiple times at their office and calls etc. After that you will be offered a position of Product Manager with a offer letter and you negotiate for position and compensation . After this they again gives few assignment and you complete that on time and then as a feedback you come to know from HR saying the "Candidature is on Hold". This means employer has completed all formalities and hired you & when you go for negotiate they takes away offer saying reason "on hold".
So, if someone can help what steps do i have to take now?

Dear friend,

Issue of appointment letter is the starting point of the employer-employee relationship. In your case, your prospective employer has given Offer Letter but not the Appointment Letter. Therefore, you are not an employee of that company.

"Appointment Letter" is contract between employer and employee under the provisions of Indian Contract Act, 1872. However, should "Offer Letter" also be constructed as contract? It is matter of interpretation by the court. How court will interpret the act that cannot be said. However, in case if you have adequate material evidence to prove that company has taken some work from you after issuing "Offer Letter" and later backtracked and because of this backtracking, you incurred the monetary loss, then court might come to your rescue. However, much depends on how vigorous your lawyer puts forth the argument.

On the strength of the offer letter, if you have not resigned from the current job then continue your current job and forget what has happened with you!

Feedback on your Candidature: - If you had applied for the post Product Head then you supposed to be senior person. By now you could have acquired skills to identify the genuineness of the future employer. In your interaction, they must have sent some signals of unprofessionalism, disconnect between two departments etc. Your failure to capture those signals has pushed you to this predicament. Leadership demands not just reading between the lines but seeing between the lines or listening between the lines, please note.

Feedback to HR: - For a company, it is easy to put on hold filling up of vacancy even after issue of the Offer Letter. However, this is unprofessional behaviour. Unprofessionalism apart, company has no right to play with candidate's career. HR is most vocal about employee engagement or employer branding and so on. However, when the testing times arise, all this wisdom is abandoned at the altar of pleasing the boss. This is highly deplorable!

Hi Dinesh,
Thanks for quick and positive response. However, this is not all about getting offer or appointment letter and joining a company. It is all about as you rightly said Unprofessionalism of a company and "taken for a ride" approach. They must understand how much a employee puts his/her effort to get selected at higher level. It does not only includes monetary loss in terms of Half days you take, travel cost and many more but the mental loss in terms of time you spend to give your best keeping other things aside.
This disappoints employee and losses trust on brand.

Dear friend,
Life is made up of good and bad incidents. Forever, we will not get good or bad experiences. Swallow this bitter experience and move on. Those who left you in lurch were unknown to you. However, sometimes very known persons betray or back-stab us. Compared to that your bitter experience is less intense. Experience makes one mature. Consider this incident as price of acquiring maturity or even wisdom.
The incident has taught you value of values like transparency, integrity etc. Implement these values in your personal life in toto to avoid bitterness in other's mind.
All the best!
