Dear Sir,

Before the Gazette notification dated January 2017, we had already started deductions on the 21,000 wage from November 2016, which was paid in December 2016. My question is, before the gazette notification, we implemented the new wage policy, processed the payment, and submitted it with the ESIC. Will this amount be credited to our account? Additionally, will the newly added employees benefit from the prior payment of the scheduled dues for January 2017? Please advise.

Dear Srinivas, The Esic limit will be effect from Jan-2017 as mentioned in the notification, means you have to deduct the Esic from employees salary from Jan-2017’s salary. Thanks Shubham

Dear Srinivas Any payment made earlier will have no effect. you may contact the ESI accounts department for further help.

Dear Srinivas,

The amount deducted for advance salary does not attract any legal issue. The amount deducted won't adjust to other contributions. The system will accept it as overtime wages or enhanced salary during the contribution period if it is paid for the months other than April and September. The IP will get more financial benefit, if any, during his benefit period.

For the December month pay contribution on old rates and for January, you can pay on enhanced salary.
