My wife was employed as Teacher in a School. However, due to certain complications arrived on pregnancy, she was unable to continue the job and had to leave in between the academic year.
Now the Principal is not returning her Original Certificate. Even she has not been paid the salary of the work done in the entire month of October, 2014.
There was no bond of any such conditions of retaining the certificate/salary was signed before the appointment.

Original certificate is your property which you had entrusted upon to the principal for verification. Employer must have given some acknowledgment of receipt. Failure to return it amounts to of fence under section 406 IPC. You serve a notice through lawyer upon him and if he does not return it pursue criminal proceedings. If you do not want to do it then apply for duplicate certificate as per procedure of university.As regards one month pay is concerned, pl state whether school is covered by Shops and Establishment Act or any other schools education Act
