I would like to know that how to calculate overtime:
e.g. Shift time is 08:30 a.m. to 17:00 p.m. including half an hour lunch Break and two tea break of 10-10 minutes.
Now, if someone will come on 07:00 a.m.on demand of us and he leaves 18:00 p.m. so we are paying them 2.5 hours overtime.
Is it right process or can we consider 1 hour only.

Hi Parimal,
I presume your working hrs is 8.30 hr per day including lunch break. If that is the case, any employee who works more this 8 hrs per day (excluding Lunch break) is eligible to get his OT paid. So, in your case, yes you are right that you would have to pay him 2.5 hrs OT daily.
But, one question arises, if you have shift duty fixed, why is an employee coming early. Is he doing it everyday as a routine, then I guess you need to get his HOD justify, why???
Just becoz, employee is feeling happy to come early and go late does not amount to management pay the OT. But if however, there is justification that productive work is being done, then there is no harm in paying and approving such OT.

As oer section(54) of Factories Act 1948, no worker is allowed to work more than 9 hours in a day. However,as per section 56,Spreadover limit is 10.5 hours/day. That means the OT permitted is 2.5 hours in a day only. The Overtine means( Over and above the normal working hours time/shift).
In your case employee can not come of his own before his shift timings,unless permitted to do so.In that bcase section 54 will be applicable.
