Dear All,
In our company, one of staff came on Ganesh Chaturthi (25 Aug 17) holiday and doing only 4-5 hrs time pass (without intimation to sr. manager) and next day she was absent and saying that she took compensatory off.
In company total working hrs is 8-30 hrs. can she eligible for compensatory off?? how can i proof?
Also one more thing, every one in our company afraid of her attitude and nature (including director)
Please advice me on the same matter ..

1. How you came to know that she came only 4-5 hours? 2. How you know that she has not informed senior manager? 3. How you can prove she did time pass only? 4. Why Director is afraid of her attitude?

Dear Trupti,
If you can prove that, she had come to the office on a holiday for no reasons or without any work related assignment and that her boss had not permitted her to come and that she has done time pass then you can issue her a warning letter, asking for explanation, as why an action should not be initiated against her for breaking the rules.
So, go ahead, only when you have documented proof. As you yourself were not present on that day in office.
By the way, why is everybody so afraid of her... She can be outright straight forward, knowing all the laws, but still that is not actually bad so, why be afraid, if there is nothing wrong that you are doing... Just a question.

1. Without prior approval of reporting authority, one can not work on Sundays/Holidays.
2. Approve leave application form must be forwarded to HR department after taking approval of reporting authority and before availing the same.
Please put the above clause in your leave policy. It should be loud and clear.As the staff didn't obtain prior permission from reporting authority, don't entertain him.
Taking decision on compensatory off is different issue and handling employee attitude is a different issue.We should not clubbed together.
Further, please tell Why you and your director are afraid of her attitude? What type of attitude she demonstrates? As Mr. Thakre told justifying one mistake with fact and figures are not comes under the purview of bad attitude.
Fearing of her attitude and allowing for compensatory off, will give a negative message to other staffs and she may take this type advantage in future.

Dear Tripti,
This employee's attitude to defy the rules of discipline is allowed to be emboldened by your lack of corrective action and timidity on the part of even your Director.
The employee is clearly square peg in round hole and if let go unchecked, can become potential problem worker.
After ascertaining facts that she came to work on holiday without prior permission, whiled away her time and remained absent next day and claimed Com off for it, issue her show-cause notice for these acts of misconducts and take appropriate punitive action on receipt of her explanation like written warning etc.

Whether the concerned staff was called/asked to come on day of holiday?
If yes, he or she is justified for compensatory off. If no, he or she is not eligible for compensatory off.
One of his/ her own wish can not avail leave unless untill it is sanctioned.
Whether he/she was assigned any task to perform by attending office on holiday? You can call for explanation if task has not completed for which he/she called for holiday working.
Hope I have explained all your querries regarding the subject to act upon.

By seeing the above points,it seems that in your office ,no proper guidlines for the PH.As per the act if any emploee is reporting on duty as per the need,he should be given a C Off.He should be intimeted for coming on duty ,perform full duty and avail C Off on any day with proper permission fron HOD.
If that lady had done only half day work then allow her only half day leave.In punching system ,half day & full day working hours are defined .Chech the timing.
Diplay a proper a notice for availing the C off so that this matter will not arise in future.

1. Legally speaking working on holidays for employees is not allowed without express instructions of superiors. In many companies security does not allow employees to enter office premises unless they have been given instructions in writing by the concerned manager.
2. Managers allow people to work on holidays with set work targets and the work done is reviewed on very next day.
3. The Comp off so claimed is approved by the said manager with the reasons for calling the employee/s on the holiday.
4. You can first speak to the manager concerned and then to the employee. ask the employee to get the approval from his manager with whom you have already spoken to.
5. Please make process for holiday working so that undue advantage is not taken by such unscrupulous employees.
