Hiii,
one of our employee having problem in pf transfer as his earlier employer hadnot deposited pf deducted amount to his pf account n now that organisation has stopped his business. He submitted form 13 from his current organisation....how can i help him ...his previous organisation is not settleing it only saying will do will but no result ....1and 1/2 year gone this way.... He has balance pf for arround 2.5 years......please suggest....

HI Mamta Now it is not in your hands. Now it is left to the Employee & PF department. Let the employee complaint to the PF department regarding the non contribution.

Hi Ask the employee to speak to his/her previous employer or PF department. They have to approach Sr. Employees of PF department.

previous employers only saying will do ...but done nothing till date...he left company in 2009

Mamta you can suggest your employee to go directly PF office along with his PF account details.
or Else give him a pf withdrawl form he fill it and make it attest from any banking officer then he can go directly to PF department to submit his form.

Dear Mamta, presently EPF officers are responding very actively. You employee can file a e-grievance (epfigms. gov. in) with all the history with proper details of the PF acct no... amounts deducted monthly (and proof of that from the salary slip can be attached in the website). It will take atelast a month or two. After submitting the grievance you can call the respective EPF office (contact details available at epfindia. gov. in / RegSites. html).
Further if the response isnt good enough, you can raise a grievance to Personnel Department of Govt of India - wherein you are sure that your case will be taken up not less than cabinet secretary with respective PF office.

As per my knowledge, no need to run anywere, asked your employee to lodge online complain on EPFO (Complete the Grievance REgistration form) with all the details in detailed on below link

After the complain lodge PF department will take action against the Employer.

Dear Mamta,
You are saying that, his previous employer has not deposited the deducted EPF contributions to PF department and now the organisation is also shutdown.....in this case what poor employee can do and how can you help him...if the contributions are remitted to concerned employee EPF account!!!
Non- remittance of EPF contribution is criminal offence under the EPF act.
In this case, employee has the rights to file a criminal case against to the employer and the concerned employee can send legal notice or file case against to concerned EPF office for their negligence towards not inspecting the booking, challans & annual returns.
I advice pls file a case against to the Employer as well as the EPF dept.

Not remitting PF after its deduction from the EEs Salary is an offence U/s 406-409 IPC (See explanation below) S406 IPC. This is a cognizable Offence when Police can take action. Lodge the FIR with the concerned POLICE Station where his previous employer located.
AS far as expecting this money from EPFO is a Herculean Task. EPFO can not transfer the Amt which has not been credited to the EEs A/c.
There are certain provisions with EPFO to deal with similar cases, But these pro visions are seldom used.
