Dear Mr. KK,
If any employees joins an organization on 1 April of any year and does regular work without having any absenteeism apart from regular week off then will he/she be eligible for obtaining pl for that year?

Dear Jigar, This is answered in Sub-section (2) Section 79 as follows: A worker whose service commences otherwise than on the first day of January shall be entitled to leave with wages at the rate laid down in clause (i) or, as the case may be, clause (ii) of sub-section (1) if he has worked for two-thirds of the total number of days in the reminder of calender year.
In the case quoted by you, he will be entitled to PL next year & not in the year in which he joins. Regards KK

Dear Ananth: From your query, it appears you are covered under the Karnataka Shop and Establishment Act. Pl check the provisions therein. The Minimum wages as notified by the State Government from time to time
would be appliable, it has dearness allowance as a factor. But if you are paying more than the Minimum Wages then seperate factoring of Basic & DA is not needed.
Regards.
KK
