Hello,
Is it compulsory for an employee to fill up the PF form if he wants PF to be deducted.

Dear Divya,
The ceiling limit of PF is 6500/-
PF contribution is submitted under these Heads:-
1. A/c I 12% (Employee’s Share)
2. A/c I 3.67% ( Employer’s Share)
3. A/c II 1.10% (Admin Charges)
4. A/c X 8.33% (Pension)
5. A/c XXI 0.50% (EDLI)
6. A/c XXII 0.01% ( Admin Charges on EDLI)
(2, 3, 4, 5 & 6 are the Employer’s Share)
If the Basic is 6500/- than employee's contribution will be 780/-
If the Basic is Less than 6500/- than employee's contribution will be 12% of of Basic.
If the Basic is more than 6500/- than its totally depend on Employee, He/She wants the dudction on the ceiling limit(6500) or 12% of their Basic.
I think it will helps u,

Respected Sir,

Mr. Saxena ji has shared really good information but it is out of context to the query.

Also his last sentence i.e. "If the Basic is more than 6500/- then its totally depend on Employee, He/She wants the dudction on the ceiling limit(6500) or 12% of their Basic" and wrong and misleading as to fact of law.

If the Basic is more than 6500/- at the time of joining the employment and the employee is not a member of PF before, in this case only the employee has an option whether to go for PF or not. Also to contribute on more than 6500 joint request in writting to an officer not below the rank of APFC is necessary.

As regards to answer to queriest, Vishal ji has given a correct answer. Employee who is becoming a member of PF, has to fill Form 2 i.e. Declaration and Nomination Form. The employer has to take Form 11 from all the employees whether they are member of PF or not. From this form, the employer has the determine whether the employee is eligible to join the PF or not.

This posting (in reponse to your posting) is made by me so that the members will come to know the exact position of law and not to pin point on your response.

I remain.

Respected Sir,
Thank you very much for your response to my post. Thank you very much for your kind words appreciating me.
With due respect to you Sir, I submit as under:
I happen to see this old thread after 18 months. Post by Divya dated 24.06.2013 drew my attention to this thread.
I have gone through the links. I have my own views according to which Method- 2 is not correct. This is because, law says there should to equal contribution by both – employee and employer.
Employee can contribute more than 12 % on voluntarily. That is called as VPF.
Lastly, due care is taken by me always before posting any thing to prevent wrong information.
