Hi



I joined one of the 3rd larget IT company in India, where i have been working since 2005.In my tenure, i went to onsite given good business for them.



Recently, i have resigned my job due to personal problems.After 1 .5 months, from my resignation now they are asking me to produce all my previous employment documents to enable the exit process.On joining the company, they did all verificaiton.



Now, they are asking again my previous employment documents again, though they have all my employment documents .Right now, i have my previous companies employment related documents, but i dont have bank statements as i have closed my account long back and lost all my bank details, when i travelled to abroad.



Right now, i am maintianing my fund in a single bank, where i dont have any salary transaction from my previous employers.



Based on above, please advice me for the following.



1) Why they are asking now all documents after my resignation?

2) I have impression that they are playing on my career.What i can do legally?

3) Right, i am in severe personal personal, so i can't make this as high priority to resolve issue?

I saw two areas in your post. First is the employer asking you to submit the documents. Second is in managing transition .The exit process in a company will have its own requirements. Bank statements do offer credibility to the earning from the past employers.
In your situation, the only way is to appeal on the humanity ground. If the company has the policy of background verification during the exit process, there is little that can be changed. Hence would request you to be patient, share the genuine reasons and offer other supporting documents. Incase you can’t produce any bank document, do offer the form-16 filled during those years. That’s a valid proof of your earnings. Salary slips are another set of documents that they may consider.
Assorting documents at this stage will help you as you would need to submit them with your new employer. Hence please take this process on a positive note.

I have given my all my previous experience to HR, now they saying my first company guy has given a written statement that "i have not worked in their organization".

I would like to give brief about my history in the organization.

1) I joined the Company on 5 yrs back.

2) On that time like 2005, they did Background check.

3) When i was working for a client, they did Background check.

4) When went for USA visa stamping, Visa Officer specially mentioned that "we are virtually approving visa, but before issuing the visa we have to assess more information on me".Then specifially asked "what you mean by more information?".Luckily she explained clearly that "assessing more information about my criminal check, edcuation background and experience background".

5)They given visa after 2.6 months after they received the clearance.Same company only did visa processing.I was in US for more than 2 yrs.

6) After my resignation, they claiming that my first company exp is fake as they did recent verification.

7) I asked about their first verificaiton report while joined the company.They said "not require to talk about that".I keep pressing that, they said it was negative on that time itself.I asked you have communicated to me, for this question they are just talking about some policies and all.

8) Finally, i said "pls verify one more time, as thing may wrong in the report.As i worked in that company long back".For this, they said nothing.

Can you please give suggestion, "can i take this legally?". If i go legally,will i get it favour of me.

Please advice on me.

I got resignation acceptance letter, i have been contacting with HR to get all my reliving & experience letter.
I dont know, why they given resignation acceptance letter ?I dont know what they have in their mind.
Is there any possiblities, that they will not issue reliving/exp letters?

Congrats ,
If you received the resignation acceptance, half your battle is won. Now draft a letter to them stating that you would be expecting the clearance document as you need to submit it to your next organization. Give them an end date, if they don’t respond, please do mention in your mail that the resignation acceptance would be considered as a relieving and clearance document if not claimed by the company before the due date.

An acceptance letter is not a clearance letter, but you putting down an end date would make them respond. They cannot keep you running between pillars to posts. It is understood that the clearance takes time. The Full and Final settle follows it own time to finish, anything from 1 to 3 months depending on company procedure. The HR is not deemed to explain you all these processes, yet they should give you a plausible answer and not give you a silent treatment.

I am sure, you are communicating with them, but please do put an end date as set by the new organization. Please suggest your former employer the time it might take to process your full and final settlement. I am sure that duration was mentioned in the employee handbook.

Further to this, please do mention in case no information is received till the due date, the acceptance would stand as the final document. Incase the HR wants to claim on your relieving, they need to respond with the document or the exact time, be it 1 month or 3 months, within which they would be issuing you the document.

Please remain mild but firm with your communication. Whichever reply you receive from them, it will stand your supporting document for clearance.

It seems the clearance process is on the way. At the most they might get back to you with any recovery if at all it exists. So remain patience for a little longer time. You have been waiting for long, by every means refrain from reacting now and respond accurately.

Hi All
Thanks for you all your advice and guidelines. Finally, i got my all service letters after big battle, of course they asked me to pay recovery amount.
As my resignation on last year august, i received my letters dated on current month/year. Will it create any issue in future?
