kindly let me know, if services of an employee is terminated by company after completing more than 5 years service, for no fault of him, is he eligible for double gratuity.

Generally companies will not stop to pay the Gratuity unless their is any damage or loss with that particular employee. I think they may hold Gratuity under disciplinary action, it is all depend on the situation and Management decision.

Dear Member,
We do not find any provision for payment of double gratuity in Payment of Gratuity Act, 1972 even if the company terminates the employee.

Hai If the company terminate the employee, he is not eligible for Gratuity. Or it is the discretion of the Management. There is not act or provision for double gratuity. MANOKAVIN
