Dear Sir, I joined a firm in August 2006 and signed a 2 yr bond on stamp paper with a notary done. I joined as a fresher and my company game my training and the bond amount was for 2 lakhs plus the expenses incurred on me during training. Recently my marriage is settled and I will be getting married in November(thus working for 15 months) after which I need to go to the US as I would be husband works there. I never wanted to leave the organization before my bond time, but now I have to. Someone told me by producing a marriage certificate I won't be breaking the bond and the company cant take legal action against me in the future.

I have given 2 securities so will the company take action against them in the future... Sir, I don't want to cheat my organization but I don't have the money to pay them and get relieved legally.. I would not mind if they don't give me my experience certificate but I want to inform them and leave so that they can find a replacement and the work goes smoothly.. I am told to leave the org even 1 month before I have to pay the entire amount..so should I inform them...many have left without informing but I don't think it is ethical.. but if I have no other choice I have to do that way...will there be any problems in my visa I would be going by a dependant visa..please help...

as far as i am concered move with your management in a cordial manner and settle the issue and come out of the organisation and get back the bond. If they will not return then stay some more months till 2 years completed and come out. if they will not give back the bond it will implication in visa

This is a legal issue. Consult a experienced lawyer with the copy of bond. Some times somewhere such bonds are not legally valid. check with the legal professional and have clarity.

I am a lawyer practising employment laws, the Co can claim only actual expenses it may have incurred on your training, the burden will be on the Co to prove expenses, the Co cannot claim any other expenses ie. bond amount of Rs 2 lacs from anybody.
Has the Co incurred any specialised training cost on you? was it on the job training? if it was , even the claim on expenses of training will be moot.
Inform the Co about the circumstances in which u need to be relieved & go ahead.

thank you very much for your help..i am very much relieved now..yes i was trained in .net for 1 month n now i am in a project but i wish to apply a releave from the project so that they can find a replacement.Can i inform them 3 months in advance telling them about my issue and leave without any hassles...i wont mind them not giving me the experience certificate but i dont want this issue to create some problem in my visa or in my future...
