Levy of damages on belated remittance of Provident Fund contribution.
Under section 14B of the Employees Provident Funds and Misc. Provisions Act, 1952 where in employer makes default in the payment of any contirbution to the providnet fund, family Pension/Pension Fund and the Insurance Fund or in the transfer of accumlations reuired to be transferred by him under section (2) of the Section 15 of sub-section 17 or the payment of any charges payable under any other provisions of this Act or any Scheme or INsurance Scheme the Commissioner uner the powers onferred on him vide NOtifiction No.S.O548(E) 17.10.73 MWNSWS BY S.O No.2793 dated 18.08.1983 is required to recover by way of penalty such damages not exceediong the amount in arrears at the following as specified in the Schemes
Period of Dalay Rate of Dames(Percentage of arrrers
per annum)
Less than Two months 17%
Two Months and above but less than 4 months 22%
Four months and above but less than 6 months 27%
Six months above 37%
This can be paid under relevant accounts caption "Penal Damges" .
