Normally, the fines collected from the workers are to be deposited in the Welfare Fund. At the same time, there is nothing wrong if you keep it separately for use in your own organisation for the purpose exclusively related to the welfare of the workers.

Unpaid wages, per se, is an amount that is payable to the employee concerned when he demands it. The constitutional validity of this provision in the Welfare Fund Acts was discussed by the Hon Supreme Court of India in Bombay Dyeing &Manufacturing vs The State Of Bombay And Others (1958 AIR 328). It was observed that unpaid wages are unquestionably moneys which belonged to the employer.
