I would suggest you to do as Mr. Sehgal said. Please speak to the concerned HR and try to get the releiving letter as tats the key to your further career and new assignments. Apologise for leaving without notice and if you hadnt paid any notice period please pay the same and get the releiving letter.
And another thing i would caution you not to involve in any sort of measures like signing the releiving letter on your own or producing fake from your end as one of our friend had suggested becox that might get you into serious trouble and its hard to take it up further from there. I might even invite legal actions against you. So do it ethically and get your releiving letter. All the best for your efforts and success.

Hi Anil,
As you said that you have resig. acceptance of your last employer and u have presented it before your prospective employer as well. Your joining with new one should not be affected since you have a proof that you are not currently engaged with another company. Regarding any dues or something, new employer seeks another proof to avoid the same.
If you are sure that you don't have any pending dues and resigned properly ( paid short fall of notice period, if any) from ur last employer then ask your new employer to go for a background verification and get satisfied. I think they people really think about the same.
Meanwhile, try to get in touch with pre.HR to sort it out or forward a mail to your HR Head linking the issues raised.

I was going through your chain of mails and understood the issue well.

My Answer:

Many organisations have a policy in place like 'Background Check" where they do the background check of the new joinees based on the documents submitted by individual which consists ref check from last two companies where you worked, check on period you worked, salary, reporting structure and reason for leaving. It may be the case with your new employer and that could also be the reason, they are asking for relieving letter.

You can go and personally meet with the person who have appointed you in your new organisation and clarify him the situation in detail and also mention that you have the following documents, which you can submit to them like appointment letter, confirmation letter, any increment letter and resignation letter (if you have accepted copy of the resignation by you supervisor) would help them. Before joining them make this issue very clear, otherwise later you may find some difficulty. Also while meeting, carry a request letter (mentioning everything) and submit to them.

I hope this will help you.

With your earlier organisation, meet the current HR Head and request them that they can deduct your notice pay as per the contract and provide you relieving letter.

I really feel sorry for the current situation you are facing now. As you had rightly taken a decision of leaving of sinking ship but the only mistake you had committed is not informing them prior or well in advance

As a legal man I do not find any major crime you had committed here. Because out of 100 mostly 70% act like you. Because of the fear of repercussion from the then employer.

As per the Indian constitution you had got the right to work any profession of you choice and any where in India within the legal frame work on constitution.

No one can bind you under labour contract which attract bonding labour act.

The only problem is if you are owing any financial commitment with your previous management or any disciplinary action pending than getting a relieving letter form your last serviced company is difficult and prospect of joining new assignment also difficult.

If your career with the last company is clear and without any problem, simply not giving leaving notice is not at all a crime. You can send a open letter to your past employer Hr Department under copy to your new Hr HEAD stating that, the circumstance which warranted you to left the job abruptly and now you got a good chance in new assignment and requesting them to send a relieving letter within 15 days failing which you will understand that their silence will be taken in to as their consent.

You can face the new HR head boldly and explain your case. But please remember that there are humpty number of jobs available for an intelligent, honest and bold person. Failing in one entry will not be the end of the road. Be cheerful.

Mark a email of resignation with the cc to your id and BCC to the new Employer.
Many of the companies will accept this. Compleate the resgnation and other formalities from your previous company. You should always state the fact clear with your Boss and never leave without the exit formalities. Now if you have to compensate as per the rules of your previous company , just do it and move forward.
While posting just remenber never to put the names of the companies or persons involved in public.

sorry to see another colleague from IBulls facing similar problem. I am too one of the "sikar" of Ibulls. they are really the worst employer in country and they do such thing deliberately. I worked with them in 2005 and each one of us face some or the other problem while leaving. Infact there were many articles written against the company those days but company didnt change and infact got worsen. I tell you those of my friends who opted to stay back even after we left were fist promoted to motivate and immedeatly 3rd month were demoted, with an only reason that is no sales increases. Infact there sales were so enough that each one of them was earning at least Rs50000 as incentive.

In my case, I left them giving a proper notice, but to my surprise, my salary was deducted. when i inquired with Anita Nagpal the Director Hr, she said that it was deducted due to improper serving of notice. when I said i send the notice the Mr. Vipul Sharma the Zone Sales head at that time, i was told that it should have not been send to him rather should have been send to HR IBulls. I said that I was informed by the sales head himself to send the resignation to him only and he will send to HR delhi, she said then its not her problem.

I tell you my NCFM certificates are still with them and even after no. of verbal and written correspondense i have not received them nor recieved any answere to that.

As far as your problem is concerned let me tell you dear anil, releiving letter is something required by company to be given and not you. Still go to labour department and asked them that you have already left the Ibulls but not getting the required documents. They will follow up and get the recipt of your complain which will serve to you for your next employer.

If there are member from Ibull on this site, they must know the fact and if they have done something wrong then need to face. Infact should get a print of such article and show to there bosses, which will be an eye opner for them.
