In our company some of the employees are opted V E R S at separated from organization five years back, now they are enjoying pension from fund and withdrew all accumulated amount from P F
Now we woold like to hire some of them due to obvious reason - my question is
Will they be a member of P F again or not
B- Some employees have superannuated after completing 58 years of age, and they are now enjoying their pension and have withdrawn their P F , if we rehire them, do we need to contribute to their P F again?
Please guide me on the above captioned question with supporting relevant rules

An employee who has withdrawn his PF accumulations on attaining the age of 55 is an excluded employee. Excluded employee is defined not in Employees Provident Fund Act but in Employees Provident Fund Schemes. A person whose salary at the time of joining (other than an existing member) is more than Rs 15000 and an apprentice (under Apprentice Act or as per Certified Standing Orders) are excluded employees. Other than these, as per scheme 2(f) a person can be excluded from PF if he has already withdrawn the PF accumulations following two conditions. Of that one is withdrawing PF on retirement. The second is withdrawing the fund after migrating from India permanently. At the same time, an employee withdrawing PF due to termination of employment to due ill health, retrenchment, VRS, resignation etc will not qualify for exclusion. But following some verdicts if the person is already a PF pensioner he can be excluded on his rehire. Similarly, if the PF accumulations are withdrawn after his attaining the age of 55 years, he can be excluded from the coverage.
