I have one query regarding the same that wht the employee who join us on less than Rs.6500 at the time of joining and now he is getting more than that......
Other thing is if the employee is getting less than Rs 6500 and he is not interesed in PF contribution then can we (as a company) can take any written application from that employee that he himself not interested and the employers is not responsible for any mishappening
Kindly Suggest as both of these cases are happening in my firm.

Dear Ruchi,
Greetings for the day,
First of all it might be known to all that cealing of Rs. 6500/ has been increased by Rs. 15,000/- the component should be Basic+da+food conc.(if any). If Employee have earning more than of Rs. 15,000/- in above cited component they he willing to opt no contribution of epf but if less then he must go to opt. For declaration not to deduct epf he have to declare the same on form 11 which may be kept by employer.

This post was started some five years back when the PF salary ceiling was Rs 6500 and it is not due to ignorance that the salary has been put as Rs 6500.

I would like to reiterate that in order to be excluded from PF coverage the employee's salary (PF qualifying salary) at the time of joining should be more than Rs 15000. At the same time, he should not be an existing member of PF. An existing member is one who has not withdrawn his PF accumulations when he left his previous company. Therefore, when a person who has worked in some other organisation to which PF applied joins your establishment you have to check whether he was previously covered by PF and if he has not withdrawn it. This is known by means of a declaration (please see the attachment and the attachment given by Sumit Saxena is an old one) It is okay that if he gives a false declaration that he was not a member of PF or declares that he has withdrawn his PF accumulations etc and on the basis of that declration you exempt the employee from PF in your establishment.

Thank you for your insight. Let me tell you, I have been browsing CiteHr for a long time, and find it really useful and interesting! Your replies and solution to queries as just wonderful.
I have a query, though you have already made it very clear, however, I would cautiously like to ask with a scenario:
I have a new employee, he was previously employed with us in 2015 and was covered under EPF which he already surrendered after leaving us in 2015, and now since he has joined us today with 33,000 (BA+DA) and is above the ceiling limit, now I would like to know are were required to cover him under EPF since he was covered earlier with us (however the account has been surrendered in 2015 itself)? Please help!

It is true that he was a member of PF when he was with you but since he has withdrawn his PF accumulations, he is not an existing member and as such he can be excluded as his salary at the time of joining or rejoining your company is more than Rs 15000. There is no illegality in it.

Dear Madhu,
Thank you very much for your reply! Little clarification:
In form 11, it ask's for earlier EPF membership details, which need to filled since he was member of EPF earlier, which will lead to linking of his UAN and employer will have to enroll him for the EPF membership. How to go about filling the Form 11, since he was our employee perviously when he was covered, we will not be able to accept false declaration.
Kindly, suggest! How should I proceed in his case, or is there any clarification or notification for the same, which I can suggest it to my management.

Whether earlier covered does not apply to one who has already withdrawn the PF accumulations but it applies only to an "existing member" or one who has a PF Account Number. At the same time once he has withdrawn the PF, that number does not exist and he will not remain as a PF member. Therefore, you can say "No" to it.
