Employees, with a basic pay exceeding Rs. 6,500 per month, has a discretion of not joining EPF Scheme. Even if they opt to join the scheme, the employer's liability is limited to what is payable in case of an employee drawing pay of Rs. 6,500 per month.

Hi Chaya,
As per your statement for you company PF is not mandatory. Once if the total head count of the company reaches to 20 then it is mandatory to register for EPF Code. If not you can opt for voluntary Code.
If company is having PF code then
1) All the employees who's Basic is lesser than 6500/- is mandatory for contribution
2) If the Employees Basic is above 6500/- then it is optional of the employees whether to contribute or not.
3) If the Basic of the employees is above 6500/- then if employee wants to contribute for PF then company should not object for contribution.
