I am completely convinced with Mukesh More. I also feel that your HR wants you to continue with your responsibilities in TCS. Finally it is upto you to decide whether to continue with TCS or not if you have some genuine problem. Try to explain your HR and ask her if she would have been in your place what she would have done. Definitely she will suggest you a fruitful solution. In line with this conversation I would also like to emphasize that in future if you dont want to join TCS then dont bother about blacklisting.

I think what she means by saying "blacklisting" is, your name in their data base is being marked as "less preferred candidate or not preferred candidate " for their future requirement. Don't worry about the nomenclature she is using. Probably, she may not hire you in her company in future, but she cannot prevent other employers to recruit you.
As long as your problem is genuine, you cannot help it.

You have mentioned that you have talked to a person in your HR dept, but you have not indicated what is the level of authority that person has in the organisation. Black listing could be the brain child of an irresponsible junior/middle management employee in you HR dept. It is always better to meet the head of your HR dept. to understand the real facts, who can probably guide you better in this situation. It is always better to leave an organisation with goodwill.

Can you explain why you feel they can not blacklist her ?
Its an internal procedure, they are free to do what they like.
They may for example, blacklist someone for bad behavior or even for unacceptable skill level or say for failure to deliver some critical task to the client. Its an internal document that is used by HR to decide that they will not hire her again ever. There is no law or rule or any thing that says you can not blacklist an employee or that you have to hire her again.
I believe that such a blacklist is also there with large BPO companies and i understand there are discussions being held to share the blacklist among the large indian bpos.

It is not possible to blacklist you on the basis of the said ground.As per as my knowledge goes the term "Black listing" involves issues like misconduct,integrity etc.I think it is their policy so best thing for you will be to talk to HR and make her understand about your problem and resolve the matter tactfully.

  • Employer is very much justified in Blacklisting a employee who chooses to leave the company within a month from joining.
  • Clearly, it is employers' choice whom to hire and whom not to hire. Why employer should rehire somebody who has ditched them within a month, in past ?
  • Moreover casual and callus attitude of new employee has costed lot of money, time efforts to the employer, hence blacklisting is justified.

Dear your HR must be doing it to keep her retention ratio down.
Well any way what she is doing is illegal and if she is really genuine get same words on mail from her. You will get to know the reality if she reply.
And if she replies(100% she won't) followup same from her senior via senior on every followup.

What do you mean by Bklack list? who is he/she to blacklist you. Is the any governing body who registered under certain standards that they can black list you. Looks very fun. HR are always talk BS without having any proper knowledge.
if they are so rigid act according to offer letter. as them in written about reason for blacklisting in written and come out. While working with your company takes this to court.
That TCS HR threaten you for blacl listing. then see where they will stand.
Don’t take tension at all, very soon Law going to come for each employee to safeguard from HR torture.

First, it's not my problem. The original poster was different. I would be supporting blacklisting actually. We also have such non serious candidates who come up with all kinds of excuses.
Please tell me which act or rules say that blacklisting on such grounds is not possible.
