Can be gratuity payable to an employee be retained if the employee is involved in a vigilance case? In our govt. organisation, a retired employee was not given the employers' contribution of PF and the gratuity amount since he was involved in a vigilance case.

Dear Mr. Suresh,
The present maximum wage/salary, for PF eligibility is Rs 6500/- p/m. If your pay is more than this limit, you can opt PF and management will allow you 12% of Rs 6500/-(Rs 780/p/m) and the same will be remitted to various heads under the scheme.
But if the management is willing to contribute with out limit as specified above, can be remitted to scheme with certain formalities like joint application and approval from PF authorities etc...

I have taken 8 months leave in the 5th year itself and i have not completed 240 days minimum days in the 5th year.
In this case am I eligible for Gratuity?

As per the above discussions, If one person leaves the company after completing 4 years and 8 months, he or she will be eligible for gratuity....is that right?

I am joined in a organisation on 1 st september 2009 and resigned on 28 august 2014 but my last working day is 12Th september 20141 and in my experience letter my job period is 1.09.2009 to 12.09.2014
