I wonder if you got a reply to your question. I too have a similar query on maternity benefits and would like to know if an employer can make such a rule or policy that a woman is entitled to maternity benefits only she serves an organisatiuon for a year and not before that. It would be very helpful if someone could respond to this and also throw some light on what defense can an organisation taken in case it denies maternity benfits to its employees until they complete one year of service.

Am I entitled to get maternity benefit from my company? Company has fired me at the end of my 6th month of maternity period without any prior notice period, by giving the reason that they cannot afford my salary any more. They are saying that they are not entitled to pay me any maternity benefit since it is a Limited liability partnership company with less than 10 employees. This company is an Educational Institute (a Private MBA college) in Maharashtra, India. I joined this company on 22nd Oct 2011 and the company asked me to leave on 1st May 2011, without giving any prior notice. Kindly suggest if I am entitled for any compensation (for firing me without any notice period) and maternity benefit (3 months paid leave or so)?

You need not pay back the salary availed out of maternity leave. Extn of leave may result in loss of pay for the extended leave period only. Don't worry, no consequences will arise out of leave extension but inform them with doctor's certificate.

Hi! i need to know if a Women Employee is in her maternity leave is she is eligible for Retrial benefits like PF, Gratuity etc for those particular 12 weeks beside her daily wages.
