Mayank Chandra is right, you have to check all the points which he has mentioned. Please note the following benefit which he can get from ESIC.
1. He will get the sickness benefit from ESIC, for that he has submit the admit & discharge certificate to the ESIC which he will get from hospital.
2. For hospital expenses & others medical test & medicine expenses, you need to go to the local AMO office and request to the Administrative Medical Officer (State Govt. Office) for reimburse the all expenses. You should communicate with them the urgency of that situation for which you had to admit him to the nearest hospital. I think, they will guide you which form & document you need to submit there.

You would have intimated to concerned ESIC Dispensary stating what has happened and as a emergency case you would be admitting him to nearest civil Hospital. As it is an emergency case you can get ESI Benfit to that employee by providing all concerned documents related to Hospitalization, Treatment, etc., given in civil Hospital. One thing I would like to tell that, even in case of any emergency first try to intimate the concerned ESI Dispensary within 24hrs of the incident/accident if the person is covered under ESIC.
The Documents to be produced in order to claim ESI Benefit are as follows
1. Doctor certificate as a emergency case.
2. Discharge summary.
3. All bills pertaining to Treatment and Medicines.
4. Form 37.
5. Permanant ESI card.
6. Employment certificate from the Employer to claim ESI Benefit.
7. Entitlement certificate from Dispensary.
8. Running Letter from Local Office.

Hi,
In the above case, ESI Act 1948 clearly state that in case of emergency if an employee is unable to reach ESI Hospital (for certain diseases)than he can take his primary treatment from his nearby hospital and will get reimbursed for that but as soon he is in a position to get shifted to ESI hospital he must do that. You have to just get a certificate from ESI doctor for your treatment in private hospital.
In the above case since its a matter of death and life of an employee his dependant can ask for the certificate from concerned ESI doctor and get reimbursement in future.

It is not clear from your question where the snake biten. Whether it is in the work spot or at his house. If it is in the work spot, it will definetely comes under the definition of accident under sec. 2(8) of the ESI Act, 1948 and that employee is entitled for both the temporary Disablement Benefit and Medical reimbursement. In case of death as a result of snake bite the dependents will get the Dependant Benefit. For all this the employer has to submit the Form 12 (old form 16) to the concerned Branch Office. No contributory condition and no past service is required. Even if you don't submit the declaration form now it can be submitted alongwith the valid reasons under what circumstances you have not submitted the declaration form and obtained the temporary or permanent card. On the other hand if the snake bite is at his home or elsewhere (not in the work spot or Office) he will get the reimbursement of the medical expenditure from the ESI Corporation on submission of the medical bills and claim form through his dispensary. For getting the medical reimbursement under the super speciality treatment the employee has to be in the insurable employment for 9 months or more and he should have contributed for atleast 78 days during the relevant contribution period corresponding to the benefit period. If he satisfied the above condition he can get the medical reimbursement in case the snake bite is out side the employment.

Dear All,
Firstly you have to submit the accident report explaining the nature of injury and the action taken to the local office. A copy you can submit to the dispensary to which the employee is attached. Once he is out of danger he could be moved to ESI hospital. You will have to collect all bills for the hospitalisation and medicines purchased. Once the employee is fit, he is to go to the dispensary to which he is attached to and apply for refund. The doctor at the dispensary will recommend refund of the amount(- subject to the rates fixed by the government) and recommend to the local office for release of this amount.
Thus the employee will get not only his accident benefit but also the cost of medication and hospitalisation - subject to some conditions as detailed above.
You may then collect the money spent on him from him.

my gentle advise is first of all you talk to esic branch manager. he will suggest the write way. But according to my knowledge after the accident accident report should be submitted in esic banch office with in 24 hrs in a priscribe form -16. after that they will continue the treatment.
