My query is related to the ESI benefit for those employees who are earning above 21,000 INR pm. Can we put him/ her into the salary calculation for monthly basis?

Employee can take benefit of ESI if he/ she comes under the salary bracket of Rs. 21,000 pm. If an employee is earning more than 21,000 pm then can he/ she take benefit of ESI.
If yes, then how is calculation should be done?

The Government has put in place certain rules and regulations and one among them is the employee's entitlement to the ESI scheme. It is for those employees whose gross salary is up to and including 21000 rupees per month, only. Once you are beyond that and finished the contributory period during which your salary has been increased, you are out of it . Plain and simple.

Ok. So we can’t give the ESI benefit to the employee whose salary is 25,000 per month.

ESI does not restrict to pay the contribution above 21000/- but the benefit ceiling will be 21000/- per month only
if the employee and employer agrees to pay ESI contribution on GROSS salary of 21000+ employees then ESIC will not stop them to continue membership, however the enhanced contribution will not give any additional benefit
