Company is not registered for PF deduction. But a new joined has a PF account. Here the question is whether his /her pf can be deducted.

If no is it going to affect the pf holder future contribution?

Any Firm which has a minimum of 10 employees has to be registered with the Employees’ Provident Fund and Miscellaneous Provisions Act. So your Company need to register first subject to applicability. After registration with PF Authorities Establishment code will be allotted after that you can start deduct PF contribution.

Without registering the employee will not be able to contribute to PF

If your establishment (to which a new employee holding a PF account has joined) is not covered by EPF & MP Act due to the reason that you do not have 20 employees, then the new employee should wait till your establishment is covered by the Act. That means, it is not possible to register an establishment just because somebody who is an existing member of PF has joined. But at the same time, if you have already 20 or more employees but you have not taken initiative to get your establishment covered, then it is a serious question of law and you have to take immediate steps to take registration. Registration or coverage of PF will be from retrospective effect from the date on which your employee strength became 20 and you will have to pay both the employees' share as well as employer's share from that date with interest and damages. Interest and damages part can be taken up in due course, but what you have to do is to get registration. Now a days at the time of registration of the company the EPF and ESI registrations will be done. Only its coverage will become pending. But in respect of proprietorship and partnership firms the registration can be taken when your number of employees reach the limit of 20.
