Experts, Please suggest when the Four New Labour Codes will be enacted.

Dear Colleague,

The Labour Ministry, Govt of India, has consolidated 29 central labour laws into four labour codes. These include the Code on Wages, the Code on Social Security, the Industrial Relations Code and the Occupational, Safety, Health and Working Condition Code.

1. As we all know the " Appropriate Government" is Central Government for certain defined class of Industries and State Government for certain class of Industries or Establishments.

2. Central Government :
As far as Central Government is concerned all the 4 Labour Codes are enacted -Passed in both houses of Parliament and accent of President given. The Rules are framed under all the 4 Labour Codes. What is pending is only the date of implementation. It is Ready and Set to GO!!

It was proposed to get implemented from 1st April 2021, then for various reasons postponed to 1st October 2021 but again the implementation date is deferred undated due to the reason that there were many representations from Employers' Organizations and Trade Unions and also mainly due to the reason that many of the State Governments are to frame Rules under the Labour Codes applicable for the respective State. Central Government is determined to implement all the 4 Labour Codes at one go from same date. Center had given time to State Governments to be ready with Rules for their respective States.

3. Sate Governments:
Most of the State Governments are either completed drafting the Rules or in the final stage to draft the Rules under the Labour Codes.

As of now the date of implementation is not clearly declared. I guess due to Covid Pandemic Industries are given some breathing time to recover from economic toughness and to come in recovery path, then the codes will get implemented.

We may believe that all the 4 Labour Codes will get implemented in FY 2022 most likely.

What we need to do as HR Professional by that time is to get the organization ready in all means on key provisions that might impact directly / indirectly and do internal risk assessment audit - find gap-have action plan for implementation ready

Dear Uddhav,

I think that the actual information you need is that when the four Labor Codes would be enforced for the Code on Wages,2019 was passed by the Parliament and received the assent of the President in 2019 and the remaining three were in 2020. Thus the four comprehensive Codes on Labor subsuming 29 existing Central Labor Laws stand already enacted in the legal sense. BUT, the date of their respective enforcement is to be notified by the Central Government after framing the Central Rules and the State Rules which is under progress. Without Rules, a Law cannot be enforced.

In fact, the Rules convert the skeletal structure of the enacted Act/Law to be a functioning organic body by providing the necessary functional inputs like appointment of administrative machinery, defining their powers, duties and territorial jurisdiction, formats of forms and notices, registers and returns, cognizance of offences by Courts and the amount of fines and/or the extent of sentences etc.
