Hi, An employee has been mailing me and even his parents started calling for the relieving letter.
He had resigned on 12th May and he had worked till 10th, he is yet to complete the exit formality i.e undertaking been mailed to him but he hasn't signed but he needs the relieving on 24th as he wants to join a new company, I need the legal advice or format to mail him to stop making his parent's calls and his mails.
Note: I have mailed him already to send a signed document of the undertaking but due to the weekend it got delayed in receiving.

He was on unpaid leave from 1-7, worked on 8th 9th Sunday 10th Monday, and he resigned on 12th, so relieving will be 10th or 12th? and do we need to pay 3days salary
No notice period as there was no appointment letter was shared. He has sent the letter mentioning you can I may propose that my last month salary can be reduced.
in appropriate proportion to adjust thirty days notice period. It is a mere suggestion so that the release/experience certificate is issued,
ps: last month's salary already been paid in full.

You cannot accept the resignation and relieve retrospectively. He has resigned on the 12th and presumably you received it also on the 12th. So you shall relieve him w.e.f 12th.
As regards salary, you have his salary for 8th-10th which is due and payable to him on completion of the exit formalities.
You can further send a clear communication that his relieving on 24th would depend on completion of exit formalities till then and to stop bringig external pressure by way of uncalled for phone calls.
