Hi,
I am working in a startup and joined it in oct 2019.
Question: An employee who was the part of core team has resigned, he joined in 2018 but the company incorporation date is Sep, 2019. Is it ok to issue the Relieving letter with the joining date as 2018?
If not then what is the solution?

Incorporation of a business entity under the Companies Act, 2013 is a legal requirement for its existence as a body corporate under law. As such, employment of people for the spade works connected with the formation of the entity is an inevitable aspect. So, the Company after its incorporation can very well mention the joining date of employees who were appointed prior to its actual date of incorporation in the event of their termination of employment later.
