Hi All, I have an query regarding Maternity Benefit.
I am working as a HR in a private concern. we have recently (Jan 1st, 2017 on-wards) covered all employees under ESIC those who are having/ earning (gross earnings) less than 21000 PM /-. Before that we have separate Mediclaim for those gross salary is greater than 15000/ - PM.
An employee, who delivered a baby on July 7th, 2017. She was under mediclaim till Dec 31st, 2016 after Jan1st, 2017 on-wards (As per the GO), she fall under ESIC contribution.
Initially she submitted her Maternity leave form-23 from ESIC, immediately within 15 days ESIC cancelled her maternity leave due to less no of services in the ESIC.
But my question is we have paid the contribution from Jan 2017 to June 2017. For this 6 months she worked minimum of 120 days (Approx calculation of physical working 20 days *6 months).
Why ESIC is not ready to provide the maternity leave to this employee. since she paid 6 months her contribution (Jan 2017 to June 2017)?
IF company wants to pay and provide her eligible leave, please suggest me how to explain this to my management that she is eligible under company mediclaim with this clauses ( please share the clauses).
Please help me to sort out this issue at the earliest.

Just want to inform you that in ESIC act for maternity benefit, IW can eligible for maternity benefit as per below situation.
For Example
Her Date of joining 01/02/2017
Her Date of Leave period after 01/11/2017
Her Expected date of delivery will be after 01/11/2017. Total 09 months complication required from date of Joining to date Date of maternity Leave period.
