Hi, I was working with a car dealership in corporate sales. I asked to resign as I did not do well there.i did that and now I have joined new company few days back. My current employer is not willing to give me My reliving and experience letter and saying that since they have asked me to resign and not satisfied with my performance so they can't provide me both the document. But my current employer is asking for the same. I was not informed about the same by HR or my immediate boss. Pls suggest me what needs to be done in this situation.

Hi Apoorva,
Please speak with your last HR as there is no other options in this. You should have completed all the formalities before you had left the organization. Some how solve the issue by pleading them for the same. Don't retaliate, as they might even issue you a termination letter.

If under-performance was the ground on which you were asked to put down your papers (i.e. officially you resigned off your own accord & your services were not terminated by the employer), then the employer has to issue a relieving letter provided:
a) There is no inquiry of fraud, etc pending against you.
b) You completed all exit - related formalities before leaving the organization.
If everything is in order & still relieving letter is being denied to you then you should initiate legal proceedings against the HR - Head of the organization.
