Hi All,
I worked in a software company in Mumbai Sakinaka aria for almost 2 years.
but there was an issue with the salary .So I have to leave it. I joined in the April 2011 and left on 30th April 2013. I served the notice period of 3 months still I didn't receive the FNF till now.
my 7 month salary is also pending there.
I followed them till now but every time got different answers only. there are saying we will intimate you once we start disbursement but when don't know . I even sent them the legal notice also but doesn't help .

Please Anybody guide me what should do ?
I need my salary and fnf .
I heard if , you don't take any action till 3 years then company can deny to pay your fnf . now I afraid , because I trust on them .during these 3 years I continuously follow them through mails phones but every time getting only hoping answers.

If any one came to this situation , please let me know what action should I take now.
I am not the only person with whom this is happening , there are many people who left company because of salary issues and all are in the same situation .but that company CEO is very powerful man , he has contacts every where .

Regarding your outstanding wages, you can claim under the Act (like shops & establishment/ payment of wages) depending on the nature of your company. However, claim should be made at the earliest or else you have to file additional petition of condonation of delay.
For F&F settlement, claim at the earliest.
Communicate through letters sent by speed post/ registered post only. And keep all your emails/ communications ready with you in case you need to prove that they have been delaying the payment inspite of your repeated requests.

hi , thanks for the reply . I heard that filing in the labour court takes long time(more than 10years) . is there other law under which I can file. Thanks Ashwini

The time frame depends on the nature of the case, geographical location of the court, number of cases pending in that court, availability of the judge (many court remains vacant for a longer period of time).
In Kolkata, a simple case of termination takes on an average of 3-5 years.
