Hi,
I m working in ### pvt Ltd company since last 1 year getting in hand salary 23 k per month.
Now, I am 8 weeks pregnant so could you please let me know
1. When I should inform company about my pregnancy to avail the maternity Benefits
2. When should I apply for leave
3. How many days leave can I avail
4. How much salary will I get in leave period (As my current in hand salary is 23 k)
Note - Today only I heard government increasing 12 weeks leave to 26 week what does that mean

Hi Buddy,
1. You can inform your employer about your pregnancy as soon as you conceived.
2. Six weeks before the expected date of delivery
3. Six week before the deliver and six week after the deliver if there is pregnancy related illness you can avail one more month leave.
4. Salary at the rate of the your average daily wage for the period of your actual absence immediately preceding and including the day of delivery and for the six weeks immediately following that day.
What you have heard (26 Week) is right however it is still in discussion stage and it is not enacted as law hence the existing 12 weeks only apply for you.

My company told me that your salary is more than 15 k so ESI will not apply to you. We can only avail leave for 12 weeks but no salary in this case.
What should I do?
Also right now I am 8 weeks pregnant and still more than 20 weeks are remaining for going on leaves so can I expect 26 weeks leave rule will apply for me

Hi,
You are entitle to leave with wages for the entire 12 weeks if your employer informs you that there is no salary for the maternity leave period than ask them to give it in witting than you can take this matter to Ass.Commissioner of Labour.
Sorry buddy, I cannot predict it, if lawmakers passed the amendment in the coming budget session of parliament than there will be chance other wise existing law only apply for you.

You are entitled to maternity benefits under MB Act 1961, if your establishment is covered by the Act and you have worked there for 80 days during the period of 12 months prior to your date of confinement.You are eligible for 12 weeks leave with salary.
