Hi,
I am Kamleshwar from Delhi. I had worked 8 years 8 month in delhi based private limited software company. After releving I came to know about gratuity. From last two month company is not replying my mail asked for gratuity. On phone, HR is not giving any proper (Accepting/Denying) reply. She is saying we are looking this matter. Please suggest me what will I do next?

Hi Kamleshwar,
When did you resign from the company? Always have the reminders over an email or a hard copy sent via registered post, without mentioning the sender's details clearly. You can very well approach the Labour office or can file claim before the Controlling Authority under the Payment of Gratuity Act within the area, your employer's establishment is situated. Once you send in a legal notice they will automatically pay you as through court they have to pay you with interest of 10 % and may be with or without fine.

Dear Mahesh,
I have resigned on may for 3 month notice. 30th Sep. was my last date. On 6th I got full n final letter. I accepted the later. Later I came to know that there was no any gratuity. I sent mail Form I on the same day to our HR Manager. She didn't reply my mail. After continuous I sent to reminder mail. But there is no any reply. On phone she is not talking about gratuity. Saying will update after discussion.
Today I have approached and submitted the application to labour office. Asst. labour officer saying that it will take time. Is there any other way/channel to complain the same?

Hi Kamleshwar, Try to seek an advocate’s advise. That should be helpful and send a legal notice so your last employer will understand the seriousness of the issue.
